SERVTHERM FORNOS À INDUÇÃO LTDA. (“Servtherm”) values you as a customer, employees, service providers, transporters and other individuals or companies that interact in industrial and commercial operations, in addition to recognizing that privacy is reciprocally important for all involved.

This Privacy Policy explains how we collect, use and disclose data when you relate to Servtherm or when you use our platform and or associated services, which will be treated in accordance with Law n. 13,709/2018 – General Personal Data Protection Law (“LGPD”).

 

What you need to know before proceeding

Personal data is all information that allows your identification or can make you identifiable. For example, your name, CPF, email, address, image, among others.

Controller is Servtherm who is responsible for decisions regarding the processing of personal data relevant to its operation.

Operator is the legal entity or natural person that processes personal data on behalf of the controller and in accordance with the privacy policy determined by them.

The person in charge is the person responsible for the protection of data being processed by Servtherm, who will be the communication channel between the data subject, the controller and the ANPD, ensuring all data protection aimed at privacy. Holder is the natural person to whom the personal data refer.

Processing of personal data means any operation, such as the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction, carried out with personal data. 

What personal data do we collect?

Personal data provided by Users/Controller have their privacy protected by the Controller/Operator. Through this Privacy Policy, the rules are established on the collection, registration, storage, use, sharing, enrichment and elimination of the data collected and/or shared by the controller within the scope of the services and functionalities of the website of the operator(s) or of the controller in accordance with the laws in force.

  • Name, email address, telephone number, and home, work, and billing addresses;
  • Official identification document required to complete employment contracts, provision of services, transport and others;
  • Date of birth and gender;
  • Geolocation;
  • Images, videos and other records;
  • Communications with us (such as representative, employee, customer, and customer support contact records for training and quality assurance purposes);
  • Other communications, made by the platform, between partners;
  • When you use our platform, we automatically collect the following types of information from your device:
  • IP adress
  • device type
  • Unique device identification numbers
  • Internet browser type (such as Firefox, Safari, Chrome and Internet Explorer)
  • internet service provider
  • Operational system
  • mobile network operator
  • How your device interacted with our online services, including the pages accessed, links clicked and resources used, along with associated times and dates
  • Exit pages and referring website details, as well as general geographic location (such as city or country)

How do we collect information about you?

There are three possible ways to collect your personal data: 

  • When you provide us with: By express authorization or by virtue of compliance with a legal or contractual obligation, and also, but not limited to, every time you provide us with personal data through our official page (Website) or through our service channels. 
  • When a third party provides us: Servtherm receives personal data from third parties, whether partners or service providers, whenever it is necessary to supplement some information about you or if necessary to evaluate the veracity of the data provided, always focusing on your security. Whenever there is a need to comply with a legal or contractual obligation.
  • When we do it automatically: When you access our website, some information will be collected automatically, including: characteristics of the device used for access, browser used for access, IP origin (with date and time), information about your interaction on Our page. Generally this information will be collected through cookies.
 

What is the purpose of processing your data? 

Personal data is processed by Servtherm for previously defined purposes and delimited below:

  • When Servtherm has to comply with legal or regulatory obligations or if it is the recipient of a court order;
  • When, by virtue of a contract, it is necessary to use your personal data in compliance with legal obligations, as well as, upon authorization, share your data to provide greater effectiveness in the fulfillment of obligations assumed by Servtherm;
  • So that Servtherm can offer its services to You through its sales force and/or administrative team, and also for sending marketing communications or participating in campaigns;
  • For activities that are of interest to Servtherm, such as market intelligence surveys, provided that You have due expectation of the occurrence of this activity, always respecting all of your rights.
  • When objectively authorized, by you, in the form of collecting an express or automated consent.

 

With whom do we share your personal data?

 Sharing your personal data with other companies or institutions, in some cases, will be necessary. Below we present the nature of the agents that may, together with Servtherm, process your personal data: 

  • With partner companies and suppliers, in the development and provision of services or offering products aimed at You, as long as they are duly approved by Servtherm’s strict security standards, examples: banks, carriers, benefit operators, etc.;
  • With authorities, government entities or other third parties, for the protection of Servtherm’s interests, in any type of conflict, including lawsuits and administrative proceedings, as well as for compliance with legal or regulatory obligations;
  • By court order or by request of administrative authorities that have legal competence for this request.

How does Servtherm keep your personal data safe? 

All data collected is protected following the best security practices adopted by the market, which includes, but is not limited to, the adoption of against unauthorized access, anonymization and encryption techniques.

All data authorized for sharing will only be shared upon the declaration of the controller and operator of the receiving party regarding the use of best “compliance and information security” practices, the adequacy of which must be guided by legal provisions (LGPD); 

Although Servtherm adopts the best efforts and best practices to preserve your privacy and protect your personal data, no transmission of information is completely secure, being always susceptible to the occurrence of technical failures, viruses or similar actions. Servtherm, focusing on transparency, will inform you after the occurrence of any event of this nature, capable of causing you any type of damage.

 

How long will Servtherm store your personal data?

Personal data processed by Servtherm will be deleted when they are no longer necessary for the purposes for which they were collected, or when you request their deletion, except in cases that allow their maintenance, including in case of need to comply with a legal obligation or regulatory authority or when necessary for the exclusive use of Servtherm, including for the exercise of its rights in judicial or administrative proceedings. 

What are my rights as a holder of personal data?

Servtherm respects and guarantees you the following rights: 

  • Confirmation whether Servtherm processes your personal data;
  • If Servtherm processes your personal data, you have the right to access this information.
  • Correction of your personal data, provided that you can prove that they are incomplete, inaccurate or out of date, and Servtherm may, if applicable, request proof by personal document or other suitable means;
  • Request the anonymization, blocking or deletion of personal data, provided that it is demonstrated that the processing of this information is unnecessary, excessive or that it occurred in breach of the General Data Protection Law;
  • Portability of personal data to another service or product provider. This right will only apply after defining the transfer pattern of this information;
  • Deletion of personal data, provided they have been collected based on consent;
  • Obtaining information about public or private entities with which Servtherm shares personal data;
  • Information about the possibilities and consequences of not providing consent, when Servtherm so requests;
  • Revocation of previously granted consent; and
  • Review of solely automated decisions that affect your interests.

Legal bases for processing:

We collect your personal data only (I) when the personal data is necessary for the performance of a contract with you (e.g. supply contract, transport, work, processing payments or creating an account at your request), (II) when the processing it is in your legitimate interest and is not overridden by your rights or (III) where we have your consent to do so. In certain cases, we will have a legal obligation to collect personal data, such as when it is necessary to use your transaction history to comply with our financial and tax obligations under the law.

If we ask for your personal data to comply with a legal requirement or to perform a contract with you, this will be made clear at the relevant time and we will let you know if the provision of your personal data is mandatory (as well as the possible consequences if you do not provide it).
